P200M LEGAL DEFENSE FUND, GAMITIN SA MGA KASO NG AFP AT PNP

MAKAKATULONG nang malaki ang pondong nakapaloob sa national budget sa pagtatanggol at magamit sa gastusin ng mga pulis at sundalo na maaaring nakaharap sa kaso habang tintutpad ang kanilang tungkulin.

“Congress has been appropriating P200 million every year for the Legal Defense Fund (LDF), which is a special provision under the lump sum Miscellaneous Personnel Benefits Fund (MPBF) in the budget,” ayon kay Surigao del Sur Rep. Johnny Pimentel, chairman ng House strategic intelligence committee.

Sa kasalukuyan aniya, ang LDF ay nagagamit sa gastos ng mga opisyales at tauhan ng mga departamento, ahensya na may kaugnayan sa administrative, civil o criminal cases laban sa mga ito kasama ang gastos sa bayad sa piyansa.

“Claims for legal expenses may be charged against the LDF. However, the expenses must be refunded to the government once the claimant is eventually found guilty by final judgement in relation to the offense charged,” sabi pa ni Pimentel.

Magugunitang sa huling State of the Nation Address ni Pangulong Rodrigo Duterte, hiniling nito sa Kongreso na magpasa ng batas para sa free legal aid sa mga tauhan ng Armed Forces of the Philippines (AFP) at ng Philippine National Police (PNP) na mahaharap sa kaso sa korte.

“To address the President’s request, Congress can tweak the LDF provision in the budget so that the fund can expressly cover meritorious cases of police officers and soldiers facing legal proceedings on account of valid and justifiable acts on the job,” sabi pa ng kongresista.

“The House appropriations committee can easily do this in consultation with the heads of the Department of Budget and Management, Department of National Defense and the Department of the Interior and Local Government,” dagdag pa nito.
